Types of Engagements

John Melluish has undertaken a variety of expert witness roles directly related to insolvency and Insolvency Practitioners, drawing on his vast experience in acting as both a Liquidator and Trustee in Bankruptcy.

Specifically he has provided opinions in relation to :-

  • Solvency as it relates to insolvent trading, preferences or any other type of action. Acting for both the plaintiff and defendant at different times.
  • The reasonableness of remuneration charged by an Insolvency Practitioner.
  • The reasonableness of the conduct of an Insolvency Practitioner in exercising a casting vote at a Section 439 A meeting.
  • The reasonableness of an Insolvency Practitioner in admitting or rejecting a creditors proof of debt
  • The reasonableness of the process undertaken by an Insolvency Practitioner in realising assets.

In accepting an assignment John will be transparent with you as an instructing party as to the cost and timing of any written report to be provided. In most instances an upfront fixed fee can be quoted based on an outline of the material to be reviewed and the questions to be answered.

Unlike many other Insolvency Experts John will undertake almost the entirety of the work himself. This ensures that when it comes time to give appear in Court, he is familiar with all aspects of the evidence and the workings used to reach the conclusions contained in his written report.
